Today, Senator Kevin Grantham (R-Cañon City) released the following statement on the failure of House Bill 1048 to survive the State, Veterans, & Military Affairs Committee:
“As the Senate sponsor of this bill, I am deeply disappointed that the House Democrats have refused to allow law abiding small business owners the authority to use deadly force if they have reason to believe the criminal intends to use force,” Grantham said. “This common sense legislation would send a warning to all criminals that if they intend to break into a business and commit a crime, they will be welcomed by properly prepared business owners who are willing to protect their lives and their livelihood.”
Susan Kochevar, a drive-in movie theater owner and operator testified in support of this bill. “I support this bill because I own a movie theater,” Kochevar said. “I believe that business owners should have the authority to protect themselves, their employees and their customers if something goes terribly wrong.”
This bill would extend protections to small business owners the authority to use deadly force in their place of business if an illegal entry was made and have a reasonable belief that they intend to use physical force against the business owner, manager or employee.
